About these terms
These terms are in two parts. Part A covers your use of this website. Part B is our terms of business for the garden design, landscaping and maintenance work we carry out, and applies together with your written quotation. "We" and "us" means Terra Preta Landscapes, a sole trader business based in Basingstoke, Hampshire. We'll update these terms if the business becomes a limited company.
Part A — using this website
Content. Everything on this site, including the words, photographs, drawings and the design of the site itself, belongs to us or is used with permission. You're welcome to browse, link to and share it. Please don't copy the photographs or text for your own use without asking.
Accuracy. We keep the site up to date, but prices, timings and descriptions are a guide and not an offer. The only binding prices are those in a written quote. Photographs show real gardens we have worked on; plants and materials vary, and results in your garden will depend on its soil, light and aspect.
Links. Where we link to other sites we're not responsible for their content or how they handle your information.
Liability for the site. We don't exclude anything the law doesn't let us exclude, but we're not liable for loss arising from your use of the site, from it being unavailable, or from relying on information on it without checking with us first.
Part B — terms of business
These Terms and Conditions apply to all domestic customers receiving landscaping or garden maintenance services from Terra Preta Landscapes. By accepting a quotation, booking a service, paying a deposit, or allowing us to begin work, you agree to these Terms.
In practice. Regular maintenance is charged at the hourly rate on the services page, with a minimum visit of four hours, and is invoiced after each visit (or monthly, if you prefer). Design and build work takes a 50% deposit on acceptance. Rates are reviewed ahead of each new financial year, in March, with at least a month's notice of any change. We carry public liability insurance of £5 million. This paragraph is a summary for convenience; the Terms below and your quotation take precedence.
1. Services
1.1 We provide domestic landscaping and garden maintenance services, which may include lawn care, hedge cutting, planting, weeding, clearance, soft landscaping, hard landscaping, and related outdoor work.
1.2 The exact Services will be set out in our quotation, schedule of works, or written confirmation.
1.3 Any work not expressly included in the quotation is outside the agreed scope and may be charged separately.
1.4 We will carry out the Services with reasonable care and skill.
2. Quotes and booking
2.1 Quotations are valid for 30 days unless we state otherwise.
2.2 Our quotation is based on the information available at the time. If we discover hidden defects, access issues, or inaccurate site information, we may revise the price before proceeding.
2.3 A contract is formed when you accept our quotation, confirm a booking, pay a deposit, or otherwise instruct us to begin work.
2.4 If you ask us to begin work during any cooling-off period, you agree that you may be charged for work already carried out if you later cancel.
3. Customer responsibilities
3.1 You must provide accurate information about the property, access, pets, underground services, boundaries, and any known hazards.
3.2 You must ensure we have safe and reasonable access to the Site on the agreed date and time.
3.3 You are responsible for obtaining any permissions needed from landlords, freeholders, neighbours, or management companies unless agreed otherwise in writing.
3.4 You must tell us about any concealed risks, including cables, pipes, drains, unstable ground, asbestos, or Japanese knotweed.
4. Pricing and payment
4.1 Prices are set out in our quotation or agreed in writing before work starts.
4.2 Unless stated otherwise, all prices are exclusive of VAT.
4.3 Unless otherwise agreed, invoices must be paid within 7 days of the invoice date.
4.4 We may require a deposit before starting work, especially for larger projects or where materials must be ordered in advance.
4.5 If payment is overdue, we may pause work until the account is brought up to date.
4.6 We may charge reasonable costs for recovering overdue amounts, including reminder fees and any lawful interest.
5. Cancellation and cooling-off
5.1 If you enter into this contract online, by phone, by email, or away from our premises, you may have a legal right to cancel within 14 days, unless an exception applies.
5.2 If you cancel during the cooling-off period before work begins, you will normally be entitled to a full refund.
5.3 If you asked us to start work during the cooling-off period, you may be required to pay for the Services provided up to the point of cancellation.
5.4 If you cancel outside the cooling-off period, or with little notice, we may charge a reasonable cancellation fee to cover our direct losses only.
5.5 Our cancellation charges are intended to reflect genuine loss and not to act as a penalty.
6. Cancellation charges
6.1 For one-off landscaping work:
- More than 7 days’ notice: no cancellation fee, except unrecoverable materials already ordered.
- 48 hours to 7 days’ notice: 25% of the quoted price, capped at our actual loss.
- Less than 48 hours’ notice: 50% of the quoted price, capped at our actual loss.
6.2 For regular garden maintenance visits:
- More than 72 hours’ notice: no fee.
- Less than 72 hours’ notice: £45, or our actual loss if lower.
- Less than 48 hours’ notice: £75, or our actual loss if lower.
- Less than 24 hours’ notice, or a missed visit due to lack of access: £100.
6.3 If we have already ordered materials or booked specialist subcontractors at your request, you will be responsible for those reasonable costs if they cannot be cancelled or reused.
7. Variations and additional work
7.1 If you request changes to the agreed work, we will confirm any revised price before carrying out the extra work where reasonably possible.
7.2 If site conditions mean additional work is necessary, we will tell you as soon as reasonably practicable and seek your approval before proceeding unless immediate action is needed to prevent damage or danger.
7.3 Additional work will be charged at the agreed rate or a fair hourly/day rate where no specific price is agreed.
8. Materials and waste
8.1 Materials remain our property until paid for in full, where applicable by law.
8.2 Where we supply materials, we may use equivalent alternatives if the original item is unavailable, provided the substitute is reasonable and suitable.
8.3 We will remove and dispose of waste only if this is included in the quotation.
8.4 Waste disposal will be handled in accordance with applicable law and environmental requirements.
9. Times and delays
9.1 Any times or dates are estimates unless we confirm a fixed completion date in writing.
9.2 We are not responsible for delays caused by weather, supplier issues, access problems, or other events outside our reasonable control.
9.3 If delays occur, we will try to notify you promptly and agree a revised schedule.
10. Completion and complaints
10.1 Please inspect the work as soon as reasonably possible after completion.
10.2 If you believe there is a problem, tell us promptly so we can investigate.
10.3 We will deal with complaints in a fair and reasonable way and, where required by law, may offer repeat performance or a price reduction.
11. Late payment
11.1 Unless otherwise agreed in writing, all invoices are due for payment within 7 days of the invoice date.
11.2 If any invoice remains unpaid after the due date, we may send a reminder and charge a reasonable administration fee of £20 to cover the cost of chasing payment.
11.3 We may also charge interest on any overdue amount at a fair and reasonable rate, calculated daily from the due date until payment is received.
11.4 If payment is overdue, we reserve the right to pause or suspend any further work, visits, or bookings until the account is paid in full.
11.5 If you believe an invoice is incorrect, you must tell us as soon as possible, but you must still pay any undisputed amount by the due date.
11.6 If we have to take further steps to recover an overdue debt, you may be responsible for any reasonable costs we incur in recovering the amount owed, to the extent allowed by law.
12. Liability
12.1 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
12.2 We are not responsible for damage caused by hidden defects, inaccurate information, pre-existing site problems, or third-party work outside our control, except where caused by our negligence.
12.3 We are not liable for indirect or consequential losses, to the extent permitted by law.
13. Data protection
13.1 We will use your personal data only as needed to provide Services, issue invoices, manage bookings, and communicate with you.
13.2 We will handle personal data in line with applicable UK data protection law and our privacy notice.
13.3 We may take regular photographs on site and in the surrounding area for the purpose of maintaining the site, recording project progress, and communicating relevant information with you.

13.5 We will only use any photographs or video footage for marketing purposes, including on our website or social media platforms, where we have obtained your prior consent.
13.6 Any consent given for marketing use may be withdrawn at any time by written notice. Where consent is withdrawn, we will take reasonable steps to cease any further use of the relevant image or footage going forward.
14. General
14.1 If any part of these Terms is found unenforceable, the rest will continue to apply.
14.2 Any change to these Terms must be agreed in writing.
14.3 These Terms, together with your quotation and any written schedule of works, make up the entire agreement between us.
15. Governing law
15.1 These Terms are governed by the laws of England and Wales.
15.2 Any dispute will be dealt with by the courts of England and Wales, unless mandatory consumer law says otherwise.
